This guide is not intended as legal advice but aims to better inform residents of the obligations, rights and expectations of community living at 18 Bourton Road.

About 18 Bourton Place

18 Bourton Place is a boutique gated community comprising 40 homes and facilities within landscaped surrounds.

Facilities include a pool, spa, barbeque and 14 visitor car parks.

What is a community titles scheme?

18 Bourton Place is a community titles scheme.

Owners have certain rights and responsibilities for their own property and for common property shared with other owners within the complex.

Examples of common property:

  • roadways and driveways

  • swimming pools and barbeque areas

  • lifts and stairways

  • letterbox areas

Exclusive use areas are common property that has been designated for the exclusive use of the owners and occupiers of a particular lot.

Examples of exclusive use areas:

  • Courtyards

  • Balconies or patios

  • Fenced yards

Exclusive use areas are shown on the registered survey plan and noted in the CMS.

What is a body corporate?

The body corporate for the community titles scheme is comprised of all owners in the scheme and must comply with the Body Corporate and Community Management Act 1997 and regulations.

The body corporate makes decisions on matters with shared responsibility including:

  • maintenance and management of common property

  • determining levies

  • public risk insurance

  • compulsory building insurance

  • establishing and enforcing by-laws relating to the management and control of lots and common property

The committee

The body corporate must elect a committee at each annual general meeting (AGM) consisting of a chairperson, secretary, treasurer and ordinary members.

Every year, all owners are invited to make a nomination to join the committee and all owners can vote on the nominations at the AGM.

The community manager

The body corporate has appointed a community manager to perform the day-to-day duties of maintaining the scheme and ensuring that the scheme complies with the legislation.

Common property

The body corporate is responsible for maintaining common property such as:

  • lawns

  • access roadways

  • swimming pools

  • stairways

  • boundary fencing

  • common doors and windows

The body corporate can engage the services of professionals such as gardeners, pool cleaners, electricians and other contractors to carry out maintenance.

What are the community by-laws?

The by-laws are a set of rules for a community titles scheme that regulate pets, noise and parking on common property.

Since our community is gated how do I get access?

Residents

Residents can enter the community by:

  • Entering an access code at the gate

  • Calling the access system from a nominated phone number

Contact the community manager to have your mobile number added to the access system.

Visitors

Visitors can gain access by entering your lot number into the access pad the the gate. The nominated phone will ring and you can speak to the visitor through the access pad. Press ‘#1’ to open the gate.

You should not provide the access code to anyone who doesn't reside in the scheme. Remember you are responsible for the behaviour of anyone who enters the scheme on your invitation.

Where can I park?

Every lot in the scheme has a garage, and some have courtyards with vehicular access. The Body Corporate has approved a special by-law that allows residents to park on driveways (which are common property).

Residents are not permitted to park in visitor parking spaces, on grassed areas, on the roadway or on the easement on the southern side of the scheme.

Repeated infringements will result in a breach notice, towing of offending vehicles and legal action against the owner.

Using the pool and BBQ facilities

The pool and BBQ facilities are available for the use of residents between the following hours:

6am-10pm

September to April

7am-9pm

May to August

Visitors may only use the facilities while accompanied by the resident. If you leave, your guests leave.

The pool facilities are used by families with children so alcohol is prohibited in the pool area.

What about noise?

Noise levels in a lot must not interfere with the peaceful enjoyment of others in their lots or on common property.

As a guide, loud music is prohibited at these times:

10pm-7am

Monday-Saturday

7pm-8am

Sunday and public holidays

Please be courteous of your neighbours and talk to your neighbours to resolve the situation. If the issue cannot be resolved then call the Police on 131 444.

When is Bin day?

Waste collection services operate on the following schedule:

General waste

Weekly on Mondays

Recycling

Fortnightly on Mondays

Can I have a pet?

Our community is pet friendly however all pets must be registered and under the control of the owner whilst on common property.

  • Cats should not be permitted to roam outside your property.

  • Dogs should be on a leash or carried.

Is smoking and vaping allowed?

Smoking and vaping are not permitted in the scheme and you may not deposit cigarette butts anywhere within the scheme.

How do I get permission to improve my property?

You need permission from the Body Corporate to make improvements to your property. Examples of common improvements are:

  • Solar panels

  • Deck

  • Airconditioning

The Body Corporate holds several insurances for the benefit of owners.

Can my agent erect a For Sale sign?

For Sale boards are permitted upon application.

What is the Owners Portal?

The Stratamax portal is our online portal for owners for documents and reports:

  • Building reports

  • Financial statements

  • CMS and survey plans

  • Insurance certificates and reports

  • Ledger card

  • Contracts and agreements
